Should I even bother with a 'wrongful death' case?
I'll try to keep this short, sorry in advance if I don't. I live in NY. Late last August (2010) my mother spontaneously fractured her left hip. She had severe Rheumatoid Arthritis, but that was it, no Osteoporosis, no Heart Disease, Diabetes, nothing else but the Arthritis and complications that go along with it. They pinned her hip and sent her to a nightmare of a rehab facility (state run) down in Rockland County. The PTs never helped her with therapy, they just told her what to do and expected her to do it on her own, including getting out of the wheel chair 4 days after surgery. She was in a diaper that they wouldn't change unless I told them to. One day I was there and they Hoyer Lift battery ran out of juice and they just undid the sling and let her fall 2 feet onto the bed. There was another time they were trying to get her to go from the bed to the wheel chair on her own and she ended up on the floor. I wasn't there for that. I tried to get her out, but her insurance kept telling me that was the only facility with a bed for her. Around the 3rd week of September she was in PT on a Friday. I'm going on what she told me because even though I was there, I was never allowed to watch PT, even from outside the room. She said they told her to get out of the wheel chair and go to the parallel bars. She said when she got out of the chair she heard a snap and got a shooting pain down her leg. She said the PTs just stood there and asked her if she was okay when she started screaming. They brought her back to the room, I tried to get them to get someone to look at her, but they wouldn't and they wouldn't let me bring someone in. They said because it was the weekend (Friday) they couldn't get someone to look at it till Monday and they couldn't send her to the hospital till someone looked at it. They did an X-ray Monday and said they saw nothing, but I was able to finally get them to send her to the hospital where they did another X-ray and found out that the hip re-broke. This time they replaced the hip and sent her to a much better rehab facility in Ulster County. Mid October the incision started to drain and she began talking, crazy I guess is the best way to describe it, just didn't make any sense when she talked. They sent her to the hospital where they thought she had a blood clot and sent her to Westchester to have it removed. They removed the clot, but her crazy talk just got worse for about a week. When her talking got a little better Westchester sent her back to the rehab in Ulster County. Somewhere in there she also had a Hemovac put on the incision to help it drain. She did a little better for a little while, but about a week before Thanksgiving the Hemovac came off, they left if off for a few days because it wasn't draining, but it started draining again. Sent her back to the hospital where they did a surgery to clean the incision out and found out that every layer of tissue was more infected with Mercer than the next, which I asked about when she was in the hospital the time before, but I was told no. The Mercer had loosened the replacement hip and they had to take it out. The night of December 3rd the night nurse at the hospital went in to give her night meds and she was fine. Half an hour later he went in to check on her and she had ped away. We had an autopsy done and it was a heart attack, but the ME said that there was no evidence of Heart Disease. What she put on the report as cause of death was "cardiac arrest brought on by stress of re breaking left hip". I had contacted the state about the 1st rehab she was in, but they told me that they couldn't send someone out there till they had more complaints. I had also contacted a lawyer after she left that 1st rehab. She had me get her records from them. $350 later I have a 2" stack of papers that they only thing you can really read is her meal records. There's no incident reports in there. They tried telling me she didn't have any, but I witnessed one myself. I haven't talked to the lawyer since a few weeks after she left there because everything else started going down hill with her and I was focusing on her. My mom was loved by all, disliked by none. All of my friends and family are telling me that I should pursue a wrongful death case against the 1st rehab. Its been a long 6 months since she ped. Grandma couldn't afford to stay in the house anymore without mom and I moved her to FL and just signed the closing papers on her house, the house I grew up in. We're burying mom's ashes tomorrow on what would have been her 63rd birthday. I miss her and grandma and quite frankly I'm kind of looking forward to this chapter of my life being over. At the same time, I want someone to pay attention to what a H*ll hole that 1st rehab is. I don't want money, I just want someone to take notice and maybe do something about this place. I don't want anyone else
