Someone just sold me counterfeit bose headphones off craigslist anything i can do i have his address and cell?

I bought these and they barely work he advertised them as brand new in box and i didnt realize they were counterfit till i took them to a bose store to see if something was wrong with them is there anything i can do? the seller is acting like hes out of town but would give me a refund if he was in town i have his address and cell phone number but thats about it.
